2.2. Incident Response Retainer: Prepaid retainer service for Clients to access immediate incident response services upon any cybersecurity incident.

2.3. Cybersecurity Consulting & Training: Customized cybersecurity consulting and training solutions tailored to meet the specific needs of Clients.

2.4. Ransomware Recovery: Specialized recovery services to restore data affected by ransomware attacks, where feasible.

2.5. Vulnerability Testing: Comprehensive vulnerability assessments and penetration testing to identify and address potential security weaknesses in Client systems.

2.6. Digital Forensics: In-depth digital forensics investigations to analyze and recover digital evidence from various devices and systems.

2.7. Data Recovery: Recovery of data from any data storage device or system, including hard drives, solid-state drives, RAID arrays, flash drives, and more.

2.8. Other Related Services: Proven Data may offer additional services related to the ones listed above, as deemed appropriate by the company.

3. Client Obligations

3.1. Accurate Information: Clients must provide accurate and complete information when engaging with Proven Data. This includes information related to the incident, data recovery, or any other services requested.

3.2. Cooperation: Clients agree to cooperate fully with Proven Data during the provision of services, including providing necessary access, permissions, and information to facilitate the service delivery.

3.3. Legal Compliance: Clients shall comply with all applicable laws, regulations, and industry standards related to data privacy, cybersecurity, and any other relevant laws concerning the services provided by Proven Data.

4. Service Limitations

4.1. No Guarantee: While Proven Data strives to provide high-quality services, we cannot guarantee the success of every data recovery, cybersecurity, or digital forensics engagement. The success of services may depend on various factors beyond our control.

4.2. Third-Party Services: Proven Data may utilize third-party tools, software, or services as part of providing services to Clients. We do not guarantee the availability, accuracy, or effectiveness of such third-party services.

5. Data Privacy and Security

5.1. Data Handling: Proven Data takes data privacy and security seriously. We will handle and protect Client data in accordance with our Privacy Policy and applicable laws.

5.2. Data Collection: In the course of providing services, Proven Data may collect certain data from Clients. This data will be used solely for service purposes and will not be shared with unauthorized parties.

6. Payment and Fees

6.1. Pricing: The pricing for our services will be communicated to the Client before engagement. Prices may vary based on the type and complexity of the services requested.

6.2. Payment Terms: Payment terms will be specified in the engagement contract or invoice. Clients must adhere to the agreed-upon payment schedule.

7. Intellectual Property

7.1. Ownership: Proven Data retains all rights, title, and interest in any intellectual property, including proprietary tools, software, or methodologies used in the provision of services.

8. Limitation of Liability

8.1. Proven Data shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the services provided, including but not limited to data loss, data breach, or system downtime.

9.1. These Terms and any disputes arising from the use of our services shall be governed by the laws of the state of Ohio. Any legal action arising from these Terms shall be brought in the courts of the state of Ohio.
